PAYMENT POLICY:
50% of the total cost of the boat service need to be paid in order to preserve the boat. The remaining 50%, as well as the cost of additional services, needs to be paid 14 days before the event takes place.
CHARTERSBCN 2013 S.L., guarantees that the equipment insured against damages and accidents to third parties with a minimum amount of 336.567,00 euro. The boat offers insurance for the passengers.
1. - CHARTERSBCN 2013 S.L., agrees to provide the boat and service for the date and hour booked.
2. - CHARTERSBCN 2013 S.L., must fulfill the terms of this contract provided that the customer has realized the payment in the given time period indicated in the “Payment Policy”.
3. - CHARTERSBCN 2013 S.L., will hand over a clean boat ready to sail to the lessee, with a crew, all the equipment indicated in the brochure and perfect security conditions according to its category.
4. -CHARTERSBCN 2013 S.L., will make every effort to deliver the boat on the date and place indicated in clause 1 and 3, but in case of not being able to comply with the agreed, a partial refund will be realized to the customer for every delay period of 30 complete minutes. If this delay exceeds 25% of the total duration of the trip, the customer will be able to cancel this agreement and will be refunded completely. In this case, CHARTERSBCN 2013 S.L. is not responsible to compensate the lessee for any other loss of whatever kind caused by the cancellation of the service. CHARTERSBCN 2013 S.L. will never take the responsibility for cancelling a service due to meteorological reasons.
5. - The authorities can perform unexpected inspection of the boat and keep it in the port during the inspection. CHARTERSBCN 2013 S.L. shall not bear any of the costs that may occur by such an investigation, neither of the delay of the service that might occur by an investigation. Meaning, that CHARTERSBCN 2013 S.L. will not refund any money for the time lost by an inspection.
6. - CHARTERSBCN 2013 S.L. has an insurance policy for the boats, equipment, and crew in case of fire, collision and third-party damages up to 336.566,77 euro. The lessee is completely covered by this policy as long as he/she is not acting negligently and as long as the current legal requirements have been fulfilled. CHARTERSBCN 2013 S.L. is not responsible for any damages or losses that may occur to personal belongings of the lesser or any members of the group of invited people aboard.
7. - The lessee commits him/her-self to prohibit any person aboard to commit any act against the current Spanish laws. In this case, this agreement will be cancelled immediately, and the lessee will be the only person held responsible by the relevant authorities.
8. - This agreement is governed by the Spanish laws and in case of dispute it will be taken to the court of Barcelona.
Realizing a payment, either half or total, leads to accepting the quote and contract of services and sales terms and conditions.
CANCELATION:
In case of cancellation by the customer:
· 30 days before the event the total amount that has been paid will be refunded.
· Between 15 and 29 days before the event, 60% of the money paid will be refunded.
· Between 3 and 14 days before the event, 50% of the money paid will be refunded.
· Between 0 and 48 hours before the event, no money will be refunded.
Once the service has been started, no money will be refunded.
In case of having an additional service included such as catering, the cancellation or change of order within 48 hours of the event will lead to a payment of 100% of the service.
In case of having third party services contracted (musicians, golf instructor, reserved spaces in port or other activities/professional), the cancellation policy of the specific services that has been contracted comes into effect.
CANCELLATION FOR METEOROLOGICAL REASONS:
48 hours before the event, we are able to receive a reliable weather forecast.
In case of a bad weather forecast, the customer has the option to cancel the service or to postpone it to another day.
In case of a cancellation caused by bad weather, the customer will be refunded the amount paid in advance, except any money paid for third party services (catering, etc.) as well as costs that arose for administration services which result in a 2% of the total amount paid.
No money will be refunded once the services has been started. This can happen by decision of the customer or by the service provider (in case of bad sea, which could threaten the passengers and the crew).
Overall, the company adopts the philosophy to achieve the goal that the customers are satisfied and having a good time. Meaning, if we think 48 hours before the event, that this satisfaction will not be achieved, we will inform and advise the customer to change or cancel the trip. At this point we would like to point out that a forecast is, as the name says, as forecast and that the reality can be different to what has been predicted. In general, these forecasts magnify the possible meteorological events.
